These Terms constitute a legally binding agreement between you (“you”, “user”, “Customer”) and BrandinAI Sp. z o.o., the operator of the BrandinAI platform (“BrandinAI”, “we”, “our”, “us”).

The Service is available to individuals who are at least 18 years old and legally capable of entering into binding contracts. By using the Service, you represent that you meet these criteria.

2. Definitions

For the purpose of these Terms:

• Account means the user-specific credentials and profile created to access the BrandinAI Service.
• BrandinAI refers to the SaaS platform available at https://brandinai.com, operated by BrandinAI Sp. z o.o.
• Customer Data refers to any information submitted, selected, or configured by the user within the Service, such as watched brands or queries.
• Generated Insight refers to content produced automatically by BrandinAI’s algorithms or artificial intelligence systems, based on third-party sources and data models.
• Service means the BrandinAI platform and all related tools, dashboards, interfaces, features, and underlying infrastructure.
• Freemium Plan means the limited free access to the Service offered without charge, subject to usage limitations described on the https://brandinai.com#pricing page.
• Subscription Plan means any paid tier of the Service that includes enhanced access, features, or analytics capabilities, as described on https://brandinai.com#pricing.
• User means any individual or entity accessing or using the Service under a free or paid plan.

3. Access and Use of the Service

To use the BrandinAI Service, you must create an Account. All access is restricted to authenticated users.

You are responsible for:

• Maintaining the confidentiality of your Account credentials.
• Ensuring all activity under your Account complies with these Terms.
• Providing accurate, up-to-date registration information.

We reserve the right to suspend or terminate your Account if you violate these Terms.

4. Subscription Plans and Billing

BrandinAI offers a freemium model. You can access a limited version of the Service at no cost.

To access additional features or extended usage, you may subscribe to a paid plan. By subscribing, you:

• Authorize recurring billing via your selected payment method.
• Agree that all subscription fees are charged in advance and may vary by plan and billing cycle.

We may modify our pricing or subscription structure at any time. Updates will appear on https://brandinai.com#pricing and take effect from your next billing cycle. If your current plan is affected, we’ll notify you in advance through the Service or other reasonable means.

5. No Refund Policy

All purchases are final. BrandinAI does not offer refunds or credits for:

• Partial use of a Subscription Plan.
• Unused features.
• Cancellations before the end of a billing cycle.

Exceptions may apply in rare cases, solely at our discretion.

6. AI-Generated Insights and Data Accuracy

BrandinAI uses large language models (LLMs) and algorithmic methods to generate insights, visualizations, and summary data. These outputs are based on third-party sources, publicly available information, and BrandinAI’s proprietary algorithms—not direct user input.

While we strive to provide relevant and useful information, you acknowledge that:

• The insights may not be exhaustive, accurate, or up to date.
• They do not constitute professional, legal, or business advice.
• You are solely responsible for evaluating and acting on any insight or recommendation.

We make no warranties regarding the reliability, completeness, or fitness for any specific purpose of the generated content.

7. Ownership and Intellectual Property

The BrandinAI platform, including its software, design, interface, models, algorithms, and code, is our exclusive property and is protected by intellectual property laws.

You retain all rights to:

• Your BrandinAI account and preferences.
• Brands, queries, or selections you configure.

BrandinAI retains all rights to:

• The Service and its underlying technology.
• Generated insights and analytic outputs, unless otherwise agreed.

You may use the outputs for any purpose, including commercial use, subject to these Terms. You are responsible for ensuring that your use complies with applicable laws and regulations.

8. Usage Restrictions

You agree not to misuse the Service. This includes, but is not limited to:

• Using the Service in a way that violates any laws or regulations.
• Attempting to reverse-engineer or extract the underlying code, data models, or methods.
• Scraping, bulk exporting, or systematically downloading large volumes of data.
• Using the Service to build a competing product or service.
• Sharing your access credentials with others.
• Overloading, disrupting, or attempting to interfere with the platform infrastructure.

We reserve the right to investigate violations and suspend or terminate access in response to prohibited use.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind.

We do not guarantee that the Service will be uninterrupted, error-free, secure, or that content will not be lost or altered.

To the extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the extent permitted by law, BrandinAI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

This includes, but is not limited to, loss of profits, data, use, goodwill, or business interruption, even if we have been advised of the possibility of such damages.

Our total liability under these Terms will not exceed the greater of $500 or the amount you paid for the Service that gave rise to the claim during the 12 months before the liability arose.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Poland.

Any disputes shall be resolved by the competent courts of Poland, unless otherwise required by applicable mandatory law.
